Sadly enough, even though I'm an american too, we were not legal when we came here. The kings of each respective country who sent people into the americas simply assumed the that noone inhabited the land, and then when reports of the natives reached the kings, they assumed them savages and turned a blind eye!

take world history, there were plenty of battles, spanish had guns too, difference was, spanish was able to introduce catholic religion to the natives of central and south america, therefore allowing the people to, in a way, merge with the spanish and their own beliefs, there were still battles, but no where near full scale war, unlike in north america, where the european nations instead attempted to "befriend" the natives, peoples of central and south have reclaimed their land, what have the natives in the U.S. done? closed themselves off from society as best they can, yeah, really fighting for your nation there, aye?
